to act judicially, and such

views could

prevent

any

action ever

by the sole Judge appointed by Her Majesty's Government for

the trial of such cases, because if the Governor had complied with his

Instructions by consulting

the

Council as to previous delinquencies

as well

as

of an officer, they would necessarily be in possession of information/subjects forming materials for charges.

"His Excellency the Governor, with the concurrence of the Council, then causes Mr Moorsom to be

called before the Council.

"Mr. Moorsom being

in

attendance, His Excellency expresses

regret at seeing him in his present position, and proceeds to

refer to the charges which have been made against

him. Having mentioned the first charge, His Excellency states that

the Form

referred

to was

called

for in the ordinary way, and was not for the Governor's private information as Mr Moorsom had asserted in his explanation. It was looked upon in the same light as other Returns which
