SAN FRANCISCO LINE

The affidavit of the pilot, who

Mount Oswald, was read. This atated that the captain told him that the foregeak was full of water, and there were no means of pamping it out except by a hand-pump. He advised the captain to put into Hampton Roads to have the ship surveyed, but he said he had been tɔ sea with the forepoak fall of water bofore and he could do it again. The deck cargo of logs was not lashed or secured during his stay on the vessel.

Mr. T. L. MacCoy, murine superintendent to the firm of Lunn and MacCoy, did not think the vessel was seaworthy with her forepeak fall of water, snd he considered that the master ought to have taken the pilot's advice, and gone into Hampton Roads and dry-dlooked there.

Crisidio Dagine, able-seaman of the Mount Oswald, a Cuban, said he left the ship in New York. He had an accident on board, and was sent ashore to hospital Ha
