1. The Mersing was properly found and equipped and in a sca- worthy condition on leaving Singapore on the 20th July, 1911.

2. The Kheng Song was pro- porly found and equipped and in a Beaworthy condition on leaving Malaces on the 28th July, 1911. ...”

3. Each vessel carried her pro per complement of oflicora as re- quired by Ordinancs II of 1882,

4. There is no evidence to show that a proper look-out was unt kept on the Morsing, In the opinion of the Court the lookout on the Kheng Seng was not pro- rorly kept.

5. The Court finds that propor steps wore taken by those in charge of the Mersing to cusure. her safe navigation, after the Khong Seng had been siglited; | but is of opinion that those in charge of the Kheng Song did-not take proper steps to ensure her safe navigation after sighting the Mersing,

6. In the opinion of the Court those in charge of ebeli vossal took proper action at the last. nonont when a collision was in- ovitable to minimise loss or damage.

7. The Court is of opinion that the master of the Kheng Song after ascertaining that his ownship was not in immediate danger should have made efforts, ourlier than he did, to ascertniu i the fate of the Mersing, and of those on lusard her, ami to ronjer necessary assistance.

8. After the collision the master

of the Mersing took proper action

to save life.
