THE CHARGE AGAINST 2BAYER.

ALLEGED FALSE PRETENCES,

30th ult.

At the Magistracy this morning, before Mr. J. R. Wood, the hearing was resumed of the casa in which A. Thayer, an America, is charged with having obtained a sum of $475.8 by fattety pretending that he had an account with the Hongkong and Shangħal Bank lo Menila.

Mr. H. L. Deneys, of the Crown Solicitor's Oce, Mr. H. W. Looker, of Messrs Deacon, Looker and Deacon, Mr. J. H-Gardiner, and Mr. A. R. Davies, manager of the Hoogkong Hotal, were la Court.

Defendont stated he was the canvasser in Hongkong of the Wah On Life Insurance Company, of Shangbal. He received his ap palatment from the agents at Cantqu. He had no connection with the Head Office. He se celved application and receipt forms: The receipts were chopped at Canton. Delendant algued on the line which bore a mark-by-the wliness. He had no chops of the company and used no books. The Company had to office in Hongkong and witness had no authority to accept risks. Witness received no salary. The anly thing he received was the first premium, On the 15th day of the 11th moon last year he received a letter from the agency at Canton requesting him to advertise for the cheapest offer. Ha sent a servant to the Sheung Po with the advertisement paid for the advertisement and later received the amount from Cantos. The word "Kingies" in the advertisema meant, "broker," Witness-gave the agency To authority to put his name in the ad vertisement. As far as he remembered only six or sevce policies passed through him, all being in respect of children. He was in the Colony when he was four years old, being altogether over fifty years in the Colony. That was the first time he appeared in that Court as a defendant.

Witness was cross-examined by Mr. Dennys, The Court having been addressed no be half of both parties, his Worship reserved his decision till Monday afternoon.

CLAIM ON PROMISSORY NOTE...

30th uli. This morning, before Mr. Justice F. A, Hazeland, Pulsee Judge, a case was called in which Oyager Singh, a watchman in the em ployment of Messrs. Mody and O., sued Kwong Oban, 6 Spring Garden Lape, and Ali Shiv, a Banitary Board-coolie, for a sum cf $45.50, of which $15 was due on a promissory note dated 12th August, and the balance in tercat thereon..

Buying month sigh.

Mr. J. H. Gardiner, who appeared. for the plaintiff, stated that the defence was that the. -promissory note was one which had been gives in substitution for another. There were two promissory nates. In the one case the smoutt was 550 and it was signed by one person. The second promissory note, upon which this claim 4 gaths' sight rested, was for $39. It was signed by two per

sons, the defendants.

Ab Shin, on being called forward, Identified the Sco promissory note as being the original one signed by him on arst June, 1910, He got the money for his own uses, and Kwong Ohau was only guarantor.

The case was further adjourned until Monday.
