Sir Richard MacDonnell appeared to have given notice, in his despatch 8141/67, to the Colonial Office of sending Ordinance No. 9 of 1871. Though he would propose the Ordinance to the Legislative Council, he could flag and brand prisoners voluntarily petitioning for release there, submitting that previous assent must be on condition that he supposes I have given assent.
I do not see any report from the Attorney General on the Ordinance, and he says the Home Government has committed an error in most other cases, but the Chinese are an exceptional people and he does not feel at all sure that Sir R. MacDonnell is right in considering it necessary in practice to be harsh, and that it should not be legalized.
I was told by Messrs. May and others that in his despatch, Sir R. MacDonnell was authorized to legalize those conditions which, in the absence of special instructions from the Secretary of State, he deems necessary. They would perhaps be singular if the Law Officers consent to do so.
I think it is more important to deter people from harbouring criminals than to spare the feelings of those who have already committed an offence.
