SHAREHOLDERS' NIGHTS.

At H. M. Supreme Court, Shanghai, on 30th mit; before Mr, F. S. A. Bourbe, acting Judge, the case J. C. E. Douglas r. D. Landale and others, directors of the Shanghai and Hong. kew Wharf Co., was again brought up

Mr. N. C. Home represented the plaintiff and Mr. Duncan McNeill the defendants.

Mr. McNeil said that he brought this matter ́up for bis Lordship's further consideration in View of the arbitrator's award, Mr. Vincent is bie Award found that this document was not One which out to have been entered by the directors upon the register of mortgages of charges. Counsel now asked his Lordship to. dismiss this action with costs.

Mr. Home said that, generally, he did not object to what was asked. The issue sel by bis Lords ip as stated in the award was: "Ought the contract in question to have bren entered by the directors upon the register of mortgage?" Counsal pointed out that the words "and charges" should be added.

His Lordship said that he believed that it was agreed "register of mortgages and charges," His Lordship had it in his adte book and also

Mr. Home draw his Lordship's attention to. the fact that the award in this case had been published already. Wheo a case was referred "to arbitration in Court the award ought not to

be published before the case came up again.

Mr McNeill stated that fie asked for and obtained the copsent of the arbitrator before the award was published. It had to be made public sooner or later and was a matter in. -which-the-public.was interested...

Mr. Hone said that reporters wout to bim and asked for a copy of the award, but he de clined to give it.

His Lordship said that unless counsel agreed it might very well have waited until it cam

into Cosit.

Mr. McNeill said that it was a matter of public interest and the people wanted it, The sanction of the arbitrator was asked and he had no objection to its publication.

On the 4th at 12.50 pThe barometer basí fallen slightly to moderately in Southers and Nofibera China respectively. It has risen slightly over Tongking.

The Japanese returns are, not yet available, but the typhoon over the Pacific would appear to be moving slowly Northwards to the South of the Loochoon.

Premuro remains low over the N,E. part of the Chins Fes, and a new depression, may be developing to the N,W..of Luzon,

Strong N.E. and N. winds may be expected in the Formoss Channel and the N.E. part of the Chitra Bea.
