The case has dragged on for no long that it may be well to recall the ficts. The Ray. H. G.. Appenzeller, of Lancaster, Pennsylvania,

·U.S.A., & missionary working in Kores, for whose loss the compensation is claimed, was a passenger on board the 0.5.K. steamer Kuma- gaza mars, which sank. in a collision with the Kisogawa-maru, also belonging to the Osaka Shore Kaisha, off Chemulpo, on June 11th, 1932, the reverend gestleman being among the drowned. An action was brought by his family against the Oaks A Shoren Kaisha claiming damages for the loss of husband and father. In bringing the suit in the Osaka Chiko Saibantho, Counsel for plain- tiffs orged that the death of the missionary was due to negligence on the part of the captain of the Kumagaia-mɑrw, who was a servant of the

In giving judgment on March 13th, 1906, the Osaka Court pointed out that from the exhibits, put-in by plaintiffs it was clear that they were entitled to receive some money from the Mini- sion after the death of Mr. Appenzeller, and it was also clear that plaintiffs, had been living in America'apart from the deceased who, if he had'

In view of these facts, the dadiages asked for were regarded by the Court as excessivo, but in cona sideration of the unhappy position of the petitipbers, who were now respectively widowed" and fatherless, and the conditions of life in America, the Court deemed it proper that compensation should be granted at the rate, of Y8,000 for each plaintif
