CLAIM FOR DAMAGES AND ALLEGED LIBEL.

Sir Heary Berkeley, KC, opened the case for the defence in the Supreme Court, this moming, in the jury action brought by the Kwong Bing Cheung firms, of Canton, against Meista, Reuter Brockelmane and Company for an injunction to restrain the defendants, their servants, and agents from falsely representing to the German Consul at Canton, and to the Chinate authorities at Canton that certain of the partners of the Cheung Loong firm," of Hongkong, sugar merchants, were also part. ners, in the plaintiff's firm; and from further endeavouring to enforce payment by the plain tiff of a debt alleged to be due to the defen dants by the Cheung Looog firm, by attach ment of property belonging to the plaintiffs, or in which they were interested. The plaiouffs, therefore, claim the sum of $10,000 damages for alleged talse representation and libel.

Sir Henry Berkeley, in brief, held that the case. presented by the plaintiffs should be dismissed without the defence being called to go further into the matter, because the plaintiffs had an action for R tori committed outside the teritorial jurisdiction, but had failed to prove that the tort complafond of was a wrong in that country in which it was alleged to have been committed as well as a wrong to this country. The second ground was that the plaintiff by their evidence bad established facts which ousted the jurisdiction of this Court, inasmuch as the evidence showed that the acts complained of as causing damage to the plaintiffs consisted is a trespass of property in China.
