Mr. Slade proceeded to read the statements" of claim and defence, as follows:-The plaintiff is a banker residing at Nanking, and carries "on business at 179, Des Vaux Road Central, under the style of Yee Sun Yuen Ket. The defence stated that the plaintiff did, on about the 3rd of January, 1907, request, be defendants to transmit the sum of Tis. 30,000 or any other sum to Shanghai either by tele- graph or otherwise. The plaintiff, they alleged, did not pay them $40,961,35 or any other sum for any purpose at all. The defendants never made any demand upon the plaintiff as alleged. The defendants never agreed to transmit Tia. 30,000 to Shanghai or any other

Continuing, Mr. Slade stated that from the above the jury could gather the alleged facts of the case. The plaintiff be would prove was the owner of the Yee Sun Yuen Kee, which firm had several branches in China. There was branch in Hongkong, which was maintained by the plaintiff, for the purpose of receiving and transmitting monies from and to the various active branches in this part of Chide. The business was a very large one, something like three or four million taels, being transmitted annually. Mr. Pollock maintained that it was not a question of.custom. If, he argued, the cam pradore introduced business to the firm, the firm could not be held liable for the fraudulent doings of the compradore. In this matter the documents were not signed by the compradore, neither did they bear his chop. -Counsel then proceeded to quote authorities to strengthen his ar ument. He then proceeded to say that if a customer did not choose to rely on the compradore he could transact his affairs with

Mr. Slade, counsel for the plaintiff, contend- ed' that the bank was liable for the actions of the compradore. The compradore, he stated; was authorized to sccept monies for the bank. This sum at issue had been paid into the bank, an it was received by a man who was authorized to receive monies by the bank, and, therefore, he held that the bank was espousible. Ther compradore, counsel stamped as a "receptacle" into which money was placed for his firm by customers, the bank, or firm thereby being held responsible for the action of the ' receptacle."

The Chief Justice summed up at length. The jury retired for about half an hour. They returned a verdict of six to one for the plaintiff.
