JUDGE'S SEVERE STRICTURES.

In H.B.M. Supreme Court, 'at Shanghai, on 22nd just before Sir Havilland de Sausierer Judge, and a jury consisting of Messrs. C. Alderten Eric Moller, P. C. Alien, A. M. Miclegi, od A. Penty,

The Crown Advocate (Mr. H. Pề`Wilkinson) assisted by Mr. S. M.,McKean, prosecuted and Mr.T. Morgan Phillips and Mr. R. A. From defended the accused,

In his address to the jury his Lordship' saidments in advance and so on, but it will be pretty obvious to you that a time must come We have been engaged for a long time on when there will be a crash.. An institution this inquiry and I crannt help thinking that such as this Watch Club then seems to me to qur time would, to a certain extent, have been be one which eminently lends itself to a clever wanted if I did not address some remarks to swindler. A man is prepared to start a club you on the case generally, although it may be of this kind and he runs it until he has got it that you are prepared at once to find a verdict very full indeed; he has got a very large num which I should be prepared to accept without ber of men in it and naturally he has got a making any further remarks on the case. But very large sum' paid to which may have 1 think, considering the notoriety which this rolled up to a considerabis amount which very Watch Club has acquired not only in Shang-likely be has fostered by delays or by means hai but throughout China-a notoriety which which a clever swindler may easily produce appears also to have reached Manila and pro- out of the fertility of his resources, and, bably other places far distant-I think that finally, there is a very large balance and of" some comment of mine on what has been

That seems gentlemen, that there is no doubt in your to me, as also it seemed to Mr. Black, the paychological stemment, for his retiring. When a clover swindler tries to get out of a concers of this kind what he does of course is to find some dupe whom he may make a stepping-stone an whom to get out of the mud and at all events whom he could unload part of his responsibiți-r| tieron to Unfortunately for him Mr. Dooley was tempted by the propositions laid before bim. bone fide honest scheme. I am not talking at the present moment in the least of the prisoner's connection with it. I have been at pains to go into the various propositions made which showed the stability, the financial soundness of this scheme as propounded by the witness Black. He tells you that a club. starts with 40 members and at the close of the 40 weeks those members, or others who have

taken their places, will have disappeared from the club. Certainly all those 40 members will haye yene because they will have paid, some of them $40 and will be entitled to a watch; the others will have taken their watches on the drawing in which they have drawn a lucky number. Now the proposition is that, every week there were 40 members before a draw. Therefore on the receipt of $400 drawing takes place and a watch valued at $26 is given to the member who draws the prize. There fore, says Black, every week will be a profit of $14. Now, gentlemen, that is perfectly true for the first 40 weeks because there cannot be more than one man getting' a watch any day during those 40 weeks. There fare at the end of the 45 weeks it is quite true you will have-in-hand-40-times $14, or $560 which you have drawn from your, contributors, But taking the case which certainly is as favour able as any to the Watch Club or to the owner of the Watch Club, the men who draw during the first 40 weeks are all of them original mem-. bers. Obviously it would be more valuable if the original members stayed in than that all

I really don't know how to describe it; it is one of the most impudent documents I ever saw unfortunately Mr. Dooley did not go into the business himself. He put it into the bands of a young accountant-al any rate he did not go. into it himself with the acumen that. denw out and nobody pays his $40 or some ody keep it going before the public, you are bound to pay. if people heard of a receiver, being put into the Watch Club there is not the least doubt that every member would have gone down and there would have been a run on the institution in double quick time. That appears. to be the pas tion of affairs, and if this inquiry has had no other useful and I think it has had the useful end of kumaking and showing up a scheme which could not possibly be an honest one and which is extremely likely to lead, with its somewhat tenipling propositions, to the dela- sion of a very large number of Chinamen in thisFFICES on TOP FLOOR, No. 1, CON country. Now I don't intend to labour the question as to its being a rotten and fraudulent roscern, and we now come to the question of Mr. Dooley's and the prisoner's connection with concern.he Crown Alvocate opened one case to you and alleged that Thomas knew. who has only come in for the first time, say after the zoth week draws a watch. Therefore we will assume for the moment, which I think is a fair assumption, that all the original mem -bers have paid 40 weeks. Then, says Black, that doesn't matter in the least because on the first week of the second 40 weeks you still ge your $47. Quite true you do, but there will be certainly on that week one which matures, ons watch for which Sto' has been paid, because you will remember that one man came in at the end of the first week and would have paid $40. So that certainly for every week under the most favourable circumstances for the Watch Club, one watch will be maturing, one member will have paid his whole $40 and he will get his watch. That may be all right, but you are going to have a lottery as well, and it is impossible to conceive that unless there is manipulation the number which is drawn out as a winning number will be a watch which is matarable- Therefore the presumption is that on a great many days in that second period of 40 weeks you will have to provide two watches instead of one. That shows ope discrepancy in the very glib description given by Black of this concern. This man suggests methods of wind:
