The principles upon which extradition is based were laid down in the Report of the Royal commission on Extraditian of 1878:
That it is the common interest of man- kind that offences against person and pro- perty, offences which militate against the well being of society, should be repressed by punishment, as the means of deterring others from commising, "as well as the cristinal himself from repeating, the of fence, as also disabling the offender, either puelly or temporarily, from further crime, (2). It has happened in the past that the ends of justice have been in some 'danger of defeat owing to the fact that a person guilty of a criminal offence has sought refuge in a country with which no extradition treaty had been ar runged, it is possible, however, for the Crown to conclude a treaty with what is known as a retroactive flee; that is, to apply to offences commuted before it is made; and in ene notorious case during recent years this, power was brought into operation.
