Robson, 30th July, vania, U.9.A, against the Osaka Shosen Kaisha for compensation amounting to Y110,8c for the death of the reverend gentleman, who wa drowned on June 11th, 1901, in the collision between the 0.5.K, steamers Kisogawe and Kumayawn. The plaintiffs, Mrs. Appenzeller and her four children, held that the death of the missionary was due to negligence on the part of the captain of the Kumag-mua-maru. The misi

•sionary at the time of his death was in receipt of an annual salary of $1,650 from the Methodist Mission, and as he would have lived 241 years. longer, according to the law of averages, the plaintiff claimed an amount equal to the salary which would have been due to him, amounting to Y80,850. In addition they each claimed Yoooo damages for personal distress at their bereavement.

The Osaka Chiko Saibanshe awarded judge' ment for Y8,000 for each plaintiff-Y40,000 in all, holding that from the exhibits put in by the plaintiffs it was clear that they were entitled to receive some money from the mission after the death of the missionary. It was afin clear that the plaintiffs had been living apart from the deceased, and if he had lived he would have required a part of his salary for his own muin- tenance, In view of these facts, the damages claimed were excessive, but in consideration

of the unhappy life of the plaintiffs, who were now widowed and fatherless, the conditions of

living in America, the Court deemed it proper that compensation should be paid at the rate of ¥8,000 for each plaintiff. Against this decision both the plaintiffs and the defendant company appealed. The Appeal Court has quashed the judgment of the Osaka Court, and dismissed the claim

The respondents (the Osaka Shosen Kaisha) admitted all the facis advanced by the plain

tiffs and the claim, but maintained that they would abandon the Kumugatua-maru, lying at the bollam of the sea off Chemalpo, to the plaintiff, and thus free themselves from liability, according to Article $44 of the Com- mercial Cnde, which provides :--" A shipowner can free himself from liability for, acts of the master done within the limits of legal authority, or for damage to other persons caused by the acle of the master or another mariner in the performance of their duties, by abandoning at the end of the voyage-to the credite ile ship; the freight, and all claims for damages or commission which have accrued to bira in relation to the ship; unless he himself is in fault."

The Court upheld this contention, and dis- missed the claim, ordering the respondent to abandon the steamer lying at the bottom of $12. We understand that the Osaka Shanen Kaisha has been ordered in surrender the in- surance money for the KamAQATALA • PRETTY SE —— Japan Chronicle.
