Mixed Court Magistrate,

Council Recin, Shanghai, rith January, 1926. Sir! have the hon ur to forward, for the Information of the Consular. Nady, copy of letter addressed to the Council by the Mixed Court Magistrate on the 8th inkant, together with a reply therein of in-day's date.
Having reference to the questions raised by the Magistrate the
following observatiouncil desires to make the
That the action taken by the Consular Rady and the Municipal Council in instituting Police supervision at the Mixed Court, so far from be

has been shown to be essentially necessary in the interests of government. By virtue of the Land Regula tions and the peculi ir status of the Foreign Bettlement, wherein the sovereign tighis: of Chinese are admittedly modified, 'the main. lenance of law and order within Municipal limits is vested in the properly constituted judicial and executive authorities of the Settle
ment, and from this it frijows clearly that the supervision of the Mixed Court by the proper authorities, representatives of the authorities, is in accordance with the Land Regulations, and therefore entirely legal.
The fact that this fot ce supervision has only been recently introduced is admitted. but right to exercise it has undoubtedly always existed and the necessity for its introduction has for many years past grown with the interests affected by the Court's administration. It is unnecessary for the Council to refer to the abuses which have made the Court a byeword in the past, inasmuch as the Consular Body in the dispatches published last year gave good and sufficient reasons for the measure of Folice supervision then decided upon. It is, however, to be observed that since this supervision, was established its necessity has been fully demonstrated on more than one occasion. Within the past few days the Coun- cil has been compelled to draw the attention of the Consular lindy to two serious cares,
of which the Chinese Authorities have per- mitted a dangerous criminal to be at large after his arrest by the Municipal Police and his transfer
from the Mixed Court to the City Au- thorities in the other the Magistrate has ad ministered go blows to.

regards the custody of female prisoners, the Council would again draw attention to the fact, stated officially by the Senior Crasul In his letter in the Total of the 2111 June last, that, in criminal procedure there can be no dis- tinction between male and female, and that the custody of all convleted prisoners is essentially A part of that Police administration which, by virtue of the Land Regulations is vested in the Municipal Council, With. s view to can ciliating Chinese sensibilities on a matter which, administratively speaking, is of com. paratively small importance (and notwith; standing that the women's ward at the Gro! was originally built at the suggestion of the Mixed Court Magistrate) the Diplomatic and the Consular Authorities have sanctioned a modification of the constituted Police authority In this respect, by consenting to the custody of female prisoners in properly contructed calls at the Mixed Court; but it is safe 10 say that sach
would never have been made a concession Institution under supervision of the foreigo Authorities therein concerned.
