12, that "if China does not furnish sufficient funds in accordance with the new Convention in such manner as to permit of the commence- ment of the works, or if she shouki fail to con form with any other essential condition of the present Arrangement, the original provisions of the Protocol of 1951 and of Annex 17 will im mediately come again into force."
It might possibly be thought that the Viceroy's 'ulterio object in making these ap pointments was to cause further delay in the Commencement of the work, but we do not think that there Any reason to conclude that he really intended this. We presume that the fact is that he has never made himself ac- quainted with the terms of this new Conven- tion, He has simply, said tofhimself, or had It suggested to him: "Here is a sum of Th. 460,000 a year for me o spend, and my firit use of it shall be to create places for some, worthy persons who will be glad to fill them." We are not aware that he consulted the Com missioner of Customs at all; and it will be noted that his dispatch is addressed, not to the Taotai and the Commissioner of Customi who have co-equal powers in the matter, but to the Total alone; and that he does not say: "You will want some assistance in the work entrusted to you, and here are three gentlemen whom I recommend to your notice" but he makes three denile appointments with- out any authority to do so whatever.” His duty in the matter is distinctly limited to paylag his
