In the Chancery Division of the High Court of Justice, before Ms. Justice Farwell, the, case of Chang Yen mao and others. Bewick, Moreing and Co. and others was taken on and ull it was a motion by the Chinese En gineating and Mining Company, Limited, that their name might be itruck dut as plaintiffs, in the action, on the ground that the writ had been issued without the authority of the com- pany,
By the writ, in which his Excellency Chang Yen man and the Chinese Engineering and Mining Company, Limited, were named as plaintiffs, and Bewick, Morelug and Co Herben Charles Hoover, Charles Algernon Moreing, Edmund Davis, Walter Filzjames Turner, and Albert Thys appeared as defon- dante, the plaintifie claimed that the defendants Bewick, Mording and Co., C. A. Moreing, and H. C. Hoover were guilty of a breach of Irant in not conveying certain property to the plain tiff company, that the plaintiff company was Induced to enter, into an agreement with the Oriental Syndicate by the fraud of the defen dants C. A. Moreing, E. Davis, W. F. Tamor, and Albert Thys, and damages for sach breach of trust and fraud. All the individual defen!! dants are directors of the plaintiff company. It will be remembered that at the recent trial.

In support of the present motion, the recretary of the company deposed that the company had not authorised Messrs. Hollam, Sons, Coward, and Hawks ley, the solicitors for Chang, to use the name" of the company as plaintiffe, and that at inacting of the directors on March 29 last a resolution was passed instructing the solicitors of the company to take the necessary steps to prevent the name of the company being made use of by Chang in the action now pending. Messrs. Davis, Turner and Thys, who were the only defendants present at the meeting, did not vote on this resolution. A long affidavit by Mr. Hawksley was put in, setting out the circumstances which led up to the
present action, and in which it wa contended
that, baving regard to the judgment of Mr. Justice Joyce in the previous action, Chang Yen-mao was de jure director-general of the plaintiff company and as such had the right to use its name, and that the application was not made bona fida in the interests of the company and that in making it the defendants were using their position as directors in order to endeavour to shield themenives from liability. The claim was that the defendants, or some of them, thould pay to the plaintiffs a sum of about £700,000,
