The head of the plaintiff firm said that on the 8th December, 1901, he commenced deli vering coal to the defendants-in respect of a steam-launch. Cross-examined: He did not know that the launch was mortgaged nor did he know that the widow of one of the partners had under- taken to pay his bill in August of last year, During the time that he had done business with the defendants he had been paid, on account, a sum of over 1500. Judgment was given for the plaintiff for the full amount claimed with costs, but not against the defendant mentioned, but against one of the men stated to be asso- ciated with him, and who, it was stated, is out of the Colony.
DEATH OF J. J. SPOONER.
Last evening, at the Government'. Civil Hospital, there passed away an old resident and familiar figure in the person of Mr. Joseph J. Spooner, who had resided continu ously for twenty years in this Colony, The immediate cause of death was general debility. Deceased was 52 years of age. In his youth he served his apprenticeship for the sea, and subsequently entered the P. and O. S. N. Co. and rose to the position of Second Officer, his last ship being the's.s. Chutan, on which he made several trips to the East. On the outbreak of the Zulu war, he went to the Cape serving through that campaign and attaining the rank of sergeant-major, in the Caps Mounted Volunteers. Upon peace being the Police Force, but shortly after left to take up a position as excise officer in the employ of the Opium Farmer. He came to Hongkong in 1834, and roamed about in China and Japan until two years later, when he joined the Opium Farmer as excise officer, sining to be chief of that department, and remaining in the service for upwards of 18 years. Latterly he suffered considerably from theanialism, and paid several visits to Japan.. Some six months ago he was transferred to the New Territory, but tha climate apparently did not agree with him, and he was recently obliget to resign his position, owing to continued ill-health, and as he grow

Civil Hospital on Monday afternoon, in what was almost a dying condition, where he passed away quietly, about 5 o'clock fast evening. The funeral took place this afternoon at 5 o'clock, at the Happy Valley. ·
