CHINA CHOES

FROM A CORRESPONDENT IN THE" “MANCHESTER GUARDIAN" OF

THE 2ND OF JUNE.

The question of "chop, or mark, is an all important one for shippers of goods to China Perhaps, for no market in the world is it more necessary that the trade-marks upon our pro ductions should be jealously safeguarded. It was a satisfaction to find when the draft of our treaty with China (dated. 5th September, 1902) came home that one of the articles (No. 7) was hs follows-

fb be given to marks used before the establish- ment of the registry-office. This surely is a mistake and an injustice to long-established marks. A declaration is, we gather, to be mado as to the goods upon which a given mark is to be used. In one section of the recom- mendations we read: 1f after registration it. be discovered that the goods of a trade-mark are inferior to the samples at first registered the registrar shall have power to cancel the certificate of registration." If this recommenda. tion is enacted a dislocation of custom will be the outcome. It is usual to use the one marke on a variety of cloths, so far at any rate as cotton and woollen goods are con | comed. These are differentiated by a variety of colours in the stampings, in the tickets, or in the combinations of the stampings. If ono "chop" must be associated with but one cloth the value of user will be lessened con- siderably. Another recommendation is that it must be made plain, either upon the goods themselves or upon the wrappers, to whom the Chinese Government further undertake that the or a merchant": This is in accordance with Superintendents of Northern and of Southern the usual practice so far at Manchester ship- ments are concerned, it being usual to stamp trade shall establish offices within their re- spective jurisdictions under control of the Imaong name upon each piece. perial Maritime Customs, where foreign trade. marks may be registered on payment of a

It was reassuring to know that the question of trade marks was to be considered, although the wording of the article did not afford the promise of anything very effective to those who were in touch with the China trade and knew the difficulties of the case. The Foreign Office bas several times been asked for information on the subject, and the Shanghai General Chamber of Commerce has written to the Deputy Inspector-General of Customs at that port, but the only answer obtainable is that "the system will be put into effect without unnecessary delay." Our Mas chester Chamuer of Commerce, which ought to have been interested in this matter, bað shown itself to be curiously unpractical, in spite

frticley of our last treaty with China will be of little value unless it is taken hold of in' thoroughly practical fashion and moulded to some purpose by business men. If our Foreiga Office desires to do a real service to British commerce it should consult some of the leading houses which trade with the Far East. It could thus learn how our "chops” are being imitated [754 and how measures night he devised to prevent such pirating. Article 7 provides for the pro tection of British marks against imitation by Chinese subjects. That can readily be dealt with. It is also provided that offices shall be established at Tientsin and Shanghai where marks can be registered, and this, as far as it goes, may be of service. But the chief trouble that afflicts us in the matter of trade-marks in the China market is not touched by these pro- visions. When the merchant of another na tionality imports goods into China and shame fully stamps his importations with marks which are exact or very close copies of marks carried
