transverse movement to port of the Tat cheong may have obscured the red of the Perle during that moverent (I do say that it did), it is quite possible and very probable that, when that movement had been ended by the collision. those on the Skrumstad could and did see the port light of the Perla before the Perla im pinged against the Tal-cheong and just after the Tai-cheong had struck the Skramstad, Whether the Peria kept on her course, or starboarded her helm or ported her helm is not 954c)

his, estimates of time and distance are concerned: he slates that the Skrematad did not sink for 15 minutes after the Tulscheong got clear: other evidence shows that this estimate. of time was inaccurate, As.. regards distance, he says the collision took place about 600 yards from us," from 300 yards off the Metropole Hotel. If the place when he was lying off the Motro pole is made the centre of n eircle with a radius of 600 yards the circumference neither inter- sects nor encloses the place of collision na assigned by either party, though it passes collision the Perla was hundreds of yards Bearer the spot marked on exhibit 8 by the distant from the place of collision, and even master of the. Counsel for the appellant tried to shoir by models that the collision could not have occurred in the manner alleged by the evidence adduced on behalf of the Skramsinä. The vessels, according to that evidence, were pass. ing port to port with at least a clear length between their almost parallel courses, and, very shortly before collision, were distant, reckoning from stern to stera, four or five lengths. It was argued that as both vessels had their engines hard astern for that period, the collision could not have occurred, even bad the Tui. cheong starboarded. That may have been so: but the argument is untenable when the fact that the Tai-cheong did not put her engines hard astern until considerably less than three' minutes before
Mr. Morgan Phillips-Then the appent will be dismissed with costs?
The Chief Justice-Yes.
Mr. Morgan Phillips-I would ask your Lord- ship to state that exhibits be detained in Court.
The Chief Justice-Of course they will be. We do not give up any of the exhibits until we see what is going to happen.
The Court adjourned.

THE MOMENT OF COLLISION proved by the engineer's log of the Tal-cheong. As regards the collision of the Perlu with the Tat-cheong, it is clear that the former vessel impinged on the falter vessel's port side amidships. It the Toi-cheong starboarded at the critical moment, she would cross the course of the Perla and incur a risk of collision, this is evident from the Perla being on the port quarter of the Tai-Christie chief engineer is on leave. Vacancy cheong only a few lengths off and is what the master of the Taischeong fores; it is curious that what he foresaw would happen did happen The Perla's striking the Tal-cheong on the lat ter vessel's port si le was therefore the natural sequence of such a macuvre as, according to the Skramstad's evidence the Tai-cheong executed. Now take the version of the Tai- cheong and see whether the Perla, baing on the Tal-cheong's port quarter, was likely to alrike the Tri-chrong's port side amidship Accord Ing to the version, the Tai-cheong's helm was put hard-a-port an appreciable time before the collision occurred. This manoeuvre would have taken the Tai-cheong further off the course of the Perie had the Parla kept on her course, in which event she would have gone
