This case came on for heating at the Supreme Court. Mr. J. J. Fraquis, QC, (instructed by Messrs Wilkinson und Grist) appeared for the Plaintiffs. Mc. Slade for the Defendant.

Mr. Slade before proceeding with the case, informed the Court hat, Mr. Wildman had been prevented from attending the Court yes, terday owing to indisposition. He had come down stairs but had caught a fresh chill.

Mr. Slade then applied for a dismissal of the case on account of the Plaintiff's not answering certain interrogatives as ordered by the Court, The Plaintifik had had nine months in which to comply with the order of the Court but only one Plaintiff, Apatibile, had complied. The Plaintiffs had not appealed against compliance but had only asked for extension of time, This time had now-expired and Mr. Slade asked that the case might be dismissed. It was no argument that one of the plaintiffs bad answered, the order of the Court was that ali four should answer, The learned. Counsel then quoted cases in Chancery in which the Court had power to dismiss a case when its orders had not been complied with.
