Fighting Round Ladysmith. A Boer despatch from Ladysmith dated 2nd instant says that a battle has been, raging since Saturday between the Boers under Commandant Pretorius and British troops, fighting was in full swing at Spionskop and Boers under Commandants Botha and Cronje have been sent there. President Steyn was under fire in the fore: most positions of the Free Staters.

Mr. Douglas Jones-1 bave much pleasure in seconding the admirable report which we have before us, showing as it does a steady increase in what I may call the substantive business of the company. The large profits made through the sales of the property are extraneous profits, and as the Chairman has already warned us, must not be counted upon as recurring annually. That being so I think it is very wise to deal with those profits as the Directors propose, thereby strengthening the company and providing for a steady dividend and possibly an increasing one in the future, I was going to add--not being sure that Mr. that there had been some talk about capitati sing the Reserve Fund, and that I felt sure the Directors as guardians of the shareholders would be prepared to receive any proposition which could be proved or shown to be to the interest of the shareholders and to the general benefit of the company. (Hear, hear). I heartily congratulate the Managing Director, the Directors, the Secretary and, the staff of the Company fur the fine statement they have laid before us, and .I now beg to second the adoption of the report and accounts.

In this case U. Nervogna, of Wyndban Street, merchant, claimed from Wong.Shu Tong, of 14, Payn Central, as proprietor of the Tsun Wan Yai Po, and Ng-Sai Jung, of 39 Gough Street, as printer and publisher of the said newspaper, dainages for libel.

The following composed the jury-Messrs Orange (foreman), F. II. Goddard, D. W. Craddock, V. A. Caesar-Hawkins, Jolin Thur- burn, A. Turner, and E. Osborne. It was agreed that the jurors should be remunerated at the rate of $io a day each. Mr. Slade (in-

structed by Messrs. Mounsey and Brutton) appeared for the plaintiff, Mr. Robinson and Mr. Francis, Q.C. (instructed by Mr. Ewens), appeared for the defendants, Mr. Robinson for the first defendant and Mr. Francis for the second.

Mr. Slade read the pleadings in the case. Paragraph 3 of the petition said, "The Plaintiff on or about the 34th March, 1807, was appoint- ed Merchant Consul for Italy without salary for Hongkong, and in the beginning of July 1898, was further appointed merchant Consul for Italy without salary for the two provinces of Kwangtung and Kwangst, in the Empire of China" Paragraph 4 said,In the beginning. of August, 1898, the Plaintiff at his own request was relieved of his office of Consul for the said provinces of Kwangtung and Kwangsi, and was succeeded by Lientedant Ginda, and on or about the 6th June, 1899, was relieved of his office of ConsultorTiongkong and was succeeded. by Mr. E.
