NOTES AND COMMENTS.

LADYSMITH,

most substantial structure, when completed, but how long its erection is likely to take is a question which we do not feel capable of answering at present.

APPARENTLY the P. W. 19, is not aware that such a thour;hline as Garden Road, Kowloon,

is. At all events it is more like a chain of hills than a crvilized road and the residents of that quarter would welcome the advent of a few coolies and a roller with some of the new road- metal.

It is intimated the Board of Directors of the

Hongkong Land Investment and Agency Co., Lad, have decides, subject to audit, to pay a final dividend of 7 7 making a total of 12 % for the year 189), and in place Ba50,000 to an equalization al dividend fumi, carrying forward $2,352-94 to new profit and loss account. We know, that drains are rather a sore point with the Authorities and that, in the opinion of the officials, no self-respecting newspaper should ever mention them. Still we should like to point out to the officials concerned that house-drains which have never been connected with the main sewers and have no outlet are apt to became offensive. A correspondent in- forms as that sach has been the case with a new house he lately moved into. The drains refased to act properly and, after he had been in occupation house month, its cluster of the the former and the sidewalk and had never been connected with the sewer. He now wants to know whose duty it was to see that the commection was made, Possibly the P. W. D, of Sanitary Board could enlighten him!.

WE would remind our readers of the South | African Fund Variety Entertainment to be Despite the fact that it has as yet been given in the City Hall this evening. "Seals are found impossible to force the passage of the ( afl at popular prices and these who are anxious Tugela River and proceed to his relizi, Į, an avoid the crush should tum ap carly. General White still doggedly holds out at Ladysmith. The Boers are evidently anxious to capture this position before the arrival of re-inforcements, as is evidenced by the news of the attack made by them on the 7th instant, which was apparently the most desperate yet made. The gallant manner in which GENERAL WARE has conducted the defence of the beleaguered town must appeal to all, and will doubtless tend to dim, the remembrance of the disaster to the flanking coluna, the blame for which he generously took upon his own shoulders, The position of the Ladysmith garrison is a most-unenvialde one. Situated on a plain, the town is surrounded by hills, which are in the possession of the Boers, so that our tronus are, as it were, in the hottom of a basin the sides of which are held by the enemy, and that enemy is in tou great force to allow of the occupants of the basin lure ing their way dut. We are only in possession of the most meagre details of Sunday's fight, but, poor as our information is, it is easily to be seen that the action was a desperate ast gallantly EDMUND TOMKINSong and its have been MR. HERBERT EAM Film PER contested by our troops. The times, says the telegram, were some of our entrenchments earried, and three times were the Boers driven out, while the Devous have once more proved the irresistibility of the British bayonet by sweeping the Boers from a OF❘ position which they had held all day.

nakes one proud to be an Englishman to read of such a heroic defence of a position which is admitted to be a particularly poor one, but the pity of it all is flut so far, there being relieved, at least by way of the Tugela River, and if it is necessary to raise the siege of the town from the rear the question of supplies arises, and one can only hope that GENERAL WHITE and his brave men may not he starved out before the necessary relief ar rives. Of one thing we feel convinced; there will be no surrender of Ladysmith while any possibility of holding out remains.

Amoy upon the steamship deling which vessel. was totally lost on or about the 9th day of Nov., 1898. The plaintiff's further claim their costs of suit.

Mr. W. V. Drummond and Mr. E. Robinson' (instructed by Messrs. Dannys and Bowley) appeared for the plaintiffs and Mr. J. J. Francis,' Q.G., and the Hen. Hy E. Polinck (instructed by Messts,, Johnson, Stokes átul Master) for the defendants.

The following composed the special jucy Messrs. G. Moxon (foreman), C. W. Dixon, E. W. Mitchell, A. Babington, C. C. Inchbald, T. I. Rose and G. P. Lammert.

The farther Cross Examination of Hung Hu Ching, (plaintiff) by Mr. Francis, was resumed; Witness said that the business was transacted through Joo Taik. He knew Chaung Wen-te; he was the master of the Joo Tail shop, The characters written by witness in the original proceedings before the Commissioner were the same as those the witness, now mentioned as names shops and master. Too Taik, and You Te are the names of the ship and Chaung Wen-to the master's name. He had never seen the master of the Fuk Kai, nor did he know.. who were the partners in this business. He denied having suutu mi to Tientsin to buy the goods. He was not aware that this man. only took the manię of Fuk Kai to do his. business. Fuk Kai was not one of his own men nor did he belong to the Joo Taik shop. lic knew a shop in Tientsin named Tsit U for the first time after he had bought gouds from Fuk Kai. Cheing Chun is the name of one of his fires in Amuy. He did not know Sai Chang (alleged to be the master..of the Fuk Kai shop) nor had he ever seen him in Amoy, He did not know whether the Fuk Kai had branches elsewhere. He had instructed friends to buy goods for hins at Newchwang. These friends were tairoduced through Joo Taik, He beleived he received letters from Newchwang. and Chefoo. The names on these letters were the same characters as those from Tientsin. These letters came to biní direct, by his own fokis in the actin, The letter from Tientsin, he thought he received from his foki. He did not know the writing the lettur. He did not know personally Wong Kan Tsun, first witness at the commission, but lind heard of him. He did not know that he was manager of Tsit U. He only heard his name after the commission a! Tientsin. He knew his friend Joo Tuik Ind a share in some business in Tientsin'; these are many partners in the Tsit U shop.

Me. Francis finished his cruss-examination

at 11.20 a..

Mr. Drummond said he was going to put in the evidence given on behalf of the plaintiff as given in Tientsin, if it was not already in. The special document was the risk note, which Mr. Drummond wished to prove separately to Mr. Dickinson's evidence given at Tientsio.

Mr. Francis objected, as he did not consider the witness, who could not read, English, could give evidence on it.

His Lordship was willing for the document to be given to the witness.

Mr. Francis objected, as he has finished his cross-examination in which nothing had been said about the risk note.

His Lordship aflowed the note to be given to witness, and granted Mr. Francis the privilege

to re-cross-examine.

Witness, on being handed the document, said he thought it was the Tientsin policy which he received,

Mr. Francis objected, as, his learned friend bad raised a further point that the policy was a valued policy. He admitted the policy being issued, but denied that it was a valued policy. Mr. Drummond said he enly wished to prave that the plaintiff received the noto and if the defendants liked to deny their risk note they could do so.

Witness said he Fad handed the note over to either Mr. Dennys or Mr. Bowley. This finished the examination of this witness.

The next witness, Chung Sye Kuj, not being in count it was decided that both sides should read the evidence, given on either side, before the commission at Tientsin,

Sco

Chung Sye Kui, being sworn said he repre sented the Straits Insurance Office; he know Hung fu Ching Some time in December 1898 he was sent for, and be

friends to took plaintiff's two Mr. Ruy, the China Trader's Manager in Hongkong, who said that the insurance at Amoy was not yet settled and asked witness to show him any policy that he might have. Witness showed Mr. Ray a paper, and was told that that was not a proper policy but only a receipt. Mr. Ray said he did not have time to investi- gate. Witness gave this paper to the clerk and asked the two Chinamen if they did not have a proper policy, they said that in Amoy that was the policy, they did not have any other kind..
