APPLICATION TO INDICT LORD ROBERTS.

FOR "HIGH CRIMES AND MISDEMEANOURS." In the northern police count, Dublin, on July 25, Mr. John Wallace, L., who had been for sone time resident in Madras, and who now lives in Ulster street, Dublin, applied to Mr. Mahony to take informations showing that Lord Roberts and others who were members of the Madmas council, should be retuned for trial for high crimes and misdemeanours. Mr. Wallace was, it appeared, formerly member of the Indian civil service.

Mr. Wallace said he made his application under a general section of an act of parliament. for breach of duty or trust with regard to the clutics.

Mr. Mahony-What duties? Mr. Wallace-The duties of the governor or member of the Madras council.

Mr. Mahony-Was Lord Roberts a member of the council'?

Mr. Wallacee, was, and his offence is punishable as a misdemeanour. The other members of the council, including Sir Mont- stewart Grant-Duff, who was president of the council, are also guilty of misdemeanours. The statute saysBe it furth enacted that every wilful breach of the trust and duty of any officers employed, of any city governor, of any members of the council, or by any of the officers of the East India Company shall be taken as a misdemeanour, and may be pro- coded against and punished as such by virtue of this act." I charge that Lord Roberts, Sir Montstewart Grant-Duff, and the other two members of the council were members of a conspiracy, and that they were banded together in order to take bribes and commit einbezi zlements (laughter), Bad were holding lands for the purpose of trading-

Mr. Mahony-That is quite sufficient to show the nature of the charge. You rely on n case in which you show that the magistrate has no jurisdiction to entertain your application. That case applies only to England. There was a statute passed in the year 1700, in the reign of William III, by which the Court of Queen's Bench in England was given a jurisdiction in respect to high crimes and misdemeanours committed by great officers of state beyond the seas, but so far as I know, such a jurisdiction was not extended to the Irish Court of Queen's Bench. I don't think I have any jurisdiction to entertain this nintter, and shall certainly not do so without an order from the superior court,

Mr. Wallace pressed Mr. Mahony to look into certain acts of parliament.

Mr. Mahony said he had looked into the matter as carefully as possible, and if Mr. Wallace liked now he could go to the Queen's Bench or he could make an application "before the chief magistrate.

Mr. Wallace then left the Court.

On July 26, in the Court of Queen's Bench, before Mr. Justice Boyd, Mr. Wallace applied for a rule with reference to the application that he had made on the previous day to Mr. Mahony, divisional magistrate.

He referred to the statute relating to members of the councile in India, and said that the 3rd and 4th of William IV. chap. 85 provided that any member of the council,, as Lord Roberts was, who neglected to obey any order of the court of directors, would be guilty of a mis demeanour at law, for which he could be puni shed. Another statute that of rith and 12th of William 11-gave magistrates, in the place where the person complained of lived, jurisdic tion is inquire into offences committed by such

persons in India or elsewhere beyond the seas, In this connection he referred to a reported case in which it had been decided by the Queen's Trench that the magistrate should in- quire into the matter and commit the accused to the Queen's Bench. That procedure, he submitted, should be followed in the present case. He also relied on the provisions of the petty sessions att, giving a magistrate jurisdic tion to inquire into crimes or misdemeanouts committed in or out of the country.

Till to-day the evidence in the Rangoon outrage was limited principally to proving the events in connection therewith, no witnesses so tar being able to identify any of those concer ned. Today, Private Sullivan was examined. He gave the names of the soldiers he saw with the woman on the occasion. These are the present seven accused Since he made his statement to the officers about the case he had been threatened and assaulted. He was first induced to tell the truth through fear, having been identified with the two others on the

identification parade. In cross-examination Sullivan said, his first statement to the Adjutant was unirtic. He made several untrue state- ments to the Cantonment Magistrate.

The Goverment continue making enquiries sts to suitable vessels for transport, the latest approaches being to the Natal line. All the boats, however, have full cargoes awaiting them, but, if necessary, would make arrangements so

that the boats could be utilized..

As in the case of the Abyssinian and Suakim expeditions, the transport arrangements will be conducted by the Bombay Dockyard Authori ties, and only a few troops will sail direct from Calcutta. This is due to the loss of time

necessarily involved in the latter cases.

Corporal Nurse, when examined, said he could identify one man only of those present, Private Goff lle (Nurse) was ordered to make enquiries, and get the names of all the present accused. His im- pression was that he saw twenty to forty direct- ly concerned.

No Claims will be admitted after the Goods have left the Godowns, and all Claims must be sent in to the Office of the Undersigned before Noon on the 22nd instant, or they will not be recognized.

All broken, chafed, and dinged Goods are to be left in the Godowns, where they will be examined on the 19th instant.

No Fire Insurance has been effected, and any Goods remaining in the Godowns after the 19th instant, will be subject in rent.
