Mr. Shade, in sumning up the case for the defence of the first and second prisoners, pointed out to the jury that the evidence given for the prosecution and for the defence was unreconcilable, that the witnesses on one side or the other inust be guilty of perjury, that to find the prisoners guilty they must come to a clear conclusion that the witnesses' for the defence were deliberate perjurers: whereas if they found the prisoners not guilty, they need not necessarily have come to the conclusion that the witnesses for the prosecution were lying, but that it would be their duty to find a verdict of not guilty if they were ant satisfied without any reasonable doubt, that the prosecu tion had made out their case.. After comment- ing at some length on the evidence, Mr. Sinde referred to the fact that the prosecution had suppressed certain statements made by the prisoners, namely those which they ixat inade at the Police Court after they had heard die exact facts alleged against them, while the pro- secution put in and used for the purpose of made when first charged and before they could ohtaining a conviction the statements they had possibly be aware of the details of the crime of which they were accused. He argued that these statements were strongly in favour of the prisoners, and that the jury in considering their verdict must bear in mind that the prisoners made statements which helped to establish their innocence, though they were not allowed to know the contents of those statements.
