This was an appezi agalast a judgment given by the Palene Judge la suit brought by Manna Slagh against Yeung San claiming $590 on a promissory notes judgment having been given for the plaintiff.
Mr. J. J. Franci, Q.C. (instructed by Mr. C. Ewens) appeared for the appellant, and Mr. H E. Follock (tsstructed by Messrs. Wilkinson and Grist) appeared for the respondent.
The Chief Justice and the question of the course of argument had been considered by the court and they had come to the decision that it should be divided in two parts. The appellant's difficulty was that he had to distinguish his case from one before the Fall Court la 1895. If he could not do so he should satisfy the court that he should be allowed to impeach its authority, The case would be open for argument if he gained either polat; should he fall the case was if an end.

Mr. Pollock then addressed the Court. He wald that his learned friend almost at the close of his address attempted to draw a distinction between the present casa and the cass which was decided before the Tall Court in 1895 upan the ground - that fo the present care it was not strictly and technically speaking an action for debt. It would therefore be necessary for Coun rel to deal with the matter and he thought that he would succeed in convincing the Court that this action was actually an action for debt. He submitted that the expression" debt" was where an action lled for the recovery of some definite sum and he then proceeded in giving the defini tion of "debt" from various books, and quoting case,
