When the consideration of the question was resumed in 189; a special sub-committee was appointed la October of that year for the purpose of consider- ing the matter. Again in 1893, 1894 and 1835, la consequence of difficult'es about the funds and otherwise, nothing definite was done, la May, 1896, the matter was again revived and on the 15th of that month a memorandum WAY drawn up by the lewith commetty and aigned by about forty of the residents, as followY' :-**

"We, the undersigned, ara agreeable that Mets D. R. Susen, M. D. Freklel, E. R. Bellies, C.M.G., and A., J. David, should become trustees and take hold of the whole properly and availab'e funds, etc., belongleg to the Synagogue."

Counsel then proceeded and said that on the 18th April, 1896, that is prior to the appointment of the trustees, Mi Danby, who was at that time acting as architect Mr. Ballllos, wrote a follows to the Director of Public Works :-

His Lordship said the pleadings should have shown what had been done in the matter.

Mr. Pollock, continuing, said it was clearly shown in one of the letters that Mr. A. J. David absolutely knew that the whole of the lot was not intended as a hellding site for a Synagogue, The letter from Mr. Hellllos was written by a clerk and it contained an error in saying that Mr. Belillos had been holding the land for eight months out of the year. Counsel tald that this practically completed the whole case and the whole evlentson bebal! of the plaisiltis, and he submitted that they had proved the case si stated on the petition. He submitted that they had sufficiently pro red by that correspondence and by that alone, without farther evidence, that Mr. Bellias par- chased that piece of ground especially for the use and benefit of the Jewish Community in this place, and that it might be used in the interests of the Jewish Community lo the erection of a Synagogue. He declared that he purchased it for this purpose and he wrote under his swn hand that he held it for them, and was ready to transfer to them on the pa; ment of costs. Counsel submitted that there was complete declaration of trust and that Mr. Belllios had purchased, the hand representative or trustee of the Jewish Community, and that there was the clearest possible evidence is bis own band writing that he had so purchased it. He bad abrolately refused to transfer the land when called upon to do so within 12 months by the Jewish Community. Counsel weat through the letters at great length and closed his case without cailing any evidence.

Mr. Francis objected to ady correspondence being brought is after the 11th March when Mr. Belliss had refused to make the transference.

Mr. Pollock read a letter from Leigh and Oringe stating that the trustees had settled to take the whole lot. They know as well as Mo Belllion it was ast intended for the purposes of a Synagogue.
