IMPORTANT" BANK CASE,
HONGKONG AND SHANGHAI DINK V, PHRA PAKDIE
In the International Court at Bangkok (bfore Phra Thamasat, Paya Manna, Phya Chats and Mr. Seblester) on the 14th logiant the hearing of the case in which the Hongkong and Shang hal Banking Corporation seils to recover from Phra Padoes the sum of 131,145.75 sicals, the amount of overdrafts of on the defendant's account in the Plaintif Bank was com nience. Mr. W. A. G. Tilicke appeared for the Bank and Luang Sunthorn Khosa for Phra Pakdeo.
Mr. Tillcke, in opening the case, ssid that the H. & S. Back carried on banking business In Bangkok, a boalaess which "comprlzed many maiters, the naturs of which he proceeded to explain to the Court. Among these was a run- ning account, which was often opened by people In order to obtain the assistance of the Bank, which lent money in the way of overdrafts and obtained interest thereon. Shortly before the defendant became the Oplum Farmer he wont to Mr. Browns, the then Manager of the Bank, to secure the assistance of the Bank in the event of his obtaining the Farm. In the coume of number al converantions an sgreement was come to that Phrs Pakdee abould from time to time deposit in the bank his receipis az Oplum Farmer and, should thena sams, not be sufficient for his requirements, the Bank should allow him over dtalts upon which interest should be charged, In all these negotiations Mr. Maclean was pres seni, and when the defendant stated that he wisbed Mr. Maclean to att for him Mr. Browna stated that he must have that, in writing. The defendant went away and litar on came back with the following document appointing Mir, Macican his agent.
