CALCUTTA, August 19th. The Bombay High Court has recently delivered a judgment, involving the question of dylog declarations, which has given rise to much comment and to no litle dismilefaction. As la well known, the law with reference to dying declarations differs in England and la Indle. In English 1:w the statement of a deceased person is only accepted if the person at the time of making it was in the expectation of death. According to Indian law, on the other hand, a declaration of a deceased person with regard to the circumstances leading to his death is relevant whether, the person at the time of making it was or was not in the expectation of death. Mr. G. C. C. Master spocared for the plaintifs and Mr. 1. J. Francis, QC (instructed by Mr. Mannscy), represented the defendant.

The urymen were Messrs. W. B. Walker, S. J. Moser, and C. S. Gabbay.

Additional evidence was called and Mr. Francis then addressed the jury for the defence, referring to the statements contained in the alleged libellous document. It stated that the girl (the daughter of the plalatif), was disrespect fal and unfeeling, that the disregarded her basband and his parents, and that her bearing was improper, this being due, the document jadi-stated, to the had training she received from her parents, the plaintiffs. In summing up, his Lordship said there were only two points which the jury had to consider, vis, whether the statement that had been uned concerning the plaintiff was defamatory, and if

so, was it false or true. He warned the fary not to be guided in the interpretation they put upon the words by any statement made by the defendants as to the meaning they intended to convey in publishing them. It did not matter what they intended. The jury had to consider what construction would be placed apon the words by any ressonable · person who read them.
