I think with your Worship's permission we may considerably shorten the proceedings by my referring to the two letters which have passed between Mr. Dennys and myself as to what can be accepted as facts. The gist of these letters is that no objections should be raised either before the Maglatrate or during the course of any appeal proceedings as formally proved:-That the defendants were to any of the following facts not having been the Oplum Farmer and together constituted the Man Fook Company that the Man Fook Com- pany applied for and obtained the perosit which was afterwards put fa in evidence that the chests of opium particularised to the permit belonged to the defendants and that no objection would

DAMAGE TO SHIP-The Burlington (9)~ Court of Appeal, 18th July. This was an appeal agulost the decision of Mr. Justice Brace. Messrs. Thompson, Eilfatt & Co., owners of the Burlington, sued the Mayor, Aldermen, and Burgesses of Wisbech In respect of damage On the 13th, sustained by the Burlington. August lost the Burlington, while on a voynga from Holford to Sutton Bridge with wood, entered the port and barbour of Wisbech, where she was placed in a berth selected by the Harbour Master, It was not a fit and proper berth in which to place the Burlington, and the suitainei dimage which was caused by the character of the barth in which she was placed. The harbour-master ought to have examined the berth; he never did examine if, and if he had it would have been the easiest thing in the world to have found the stones which made the berth unsafe.
