Mr. W. Knox, sollchor, read a paper on "The Liability of a shipmaster on a question with bis crew." The cise was the well-known one connected with the wreck of the steamer Counters of Aberdeen al Cove, near Aberdeen, in April, 1804. No sooner had the Board of Trade Inquiry in the case concluded than the chief officer and eight of the crew rated an action against the master In the Sheriff Court of Aber. deen for payment of various sume amounting lo all to £55 189. 6d. as the alleged value of their personal ffects lost in the wreck. On the fastrac- ilons of the Association, the muster defended the action The plaintiffs took up the position that the ship was wrecked and their effects conse quently lost through the culpable and reckless Bavigation of the ship, for which they held the master responsible. The grounds taken up in London for this port on the 4th Inst, defence were (1), That the decision to the Board of Trade Inquiry could not be founded on in the action; (2) that the accident happened through Causes over which the muster had no control; (3) that the chief officer was in charge of the ship during part of the voyage, and by his negligence contributed to the casualty; and (4) that the occurence was a risk focident to the employ ment of the platifs, for the consequences which the master was in no way responsible. The Sheriff fixed a diet of prof in the case, but this
