In the sult Gash v. Kjeller, plaintiff sued for $300, damages caused by forcible detention of his boxes; and in the cross-action, Kjeller v. Gust, plaintiff sued for $40, cost of board and

Gash stated that he was employed in the Naval Yard. He stayed at Mr. Kjeller's boarding house in Wyndham Street for 25 days, and thought the charge too high. He was not satisfied with the accommodation, nor the fare: He refused to pay so much, and Mrs. Kjeller refused to let him take away his boxes. He had been put to great Inconvenience and expense, having to buy new clothing, and other things.

In reply to his Lordship, he said he did not know of any rule in boarding houses to charge at a higher rate per day than per month. He had been in other boarding houses. He thought that the sleeping accommodation was a sofa, bot bed. He could not explain what was the matter with the food."

His Lordship said this trivial case ought not to have come into court at all. The parties ought to settle it without ligation. He ad- journed until Friday, to give them an opportunity to settle the case.
