turn on the point what do the words
alons hereinafter contained as to the instite- tution of special suits and proceedings in certain suits include. Now it is obvious that causes, all suite in the Supreme Courts shall be needings of this kind on summons are con commented by a general writ of summons to be venient expeditious, and cheap, The Legislature issued by the Registrar on the filing of a precipe Iways seeks to effect that end in litigation, and for the same. Section XIII. Section 3, under i would seem that if section 9 has the effect of the head of specially ind used writs, enacts that sing away with the procedure it is rather the cases of ordinary accounts in the case of recident of verbiage than intention. Proceedings satisfy the Court that there is really some by bill and information must have been well- preliminary question to be tried, an order for the known, and it must be assumed that the account with all usual direction my be forthwith distinction between a 'cause' or 'suit and made. Leaving out of consideration for a momenta. maiter cause or a matter and suit were Section 9, it is clear enough that the proceedings recognised and therefore present to the Legis by summons in Chemned for Administration Lure who are cute that if the are not 'specially provided for and the only and it appears to me that if the Legislature provision made is for taking an account under had intended to do away with proceedings on Sub. See 3 of Sec XIII by means of a specially summons under 15 and 16-Vic. c. 86, it would endorsed writ. That also applies to partnership have used apt words to inlicate that all suits' transactions and even to suits where an account included matters and suits' or at any rate would. may be useful, although the suit proceeds in the have enacted that all suits, and other proceed usual manner (Sub sec. 4), According therefore ings should henceforth be commenced by writ to Sec. 4 of the Code there is no suspension' of of summons. The fact that so useful a provision the old practice, but on the contrary as such pro- is not expressly repealed and no corresponding ceedings are matters for which no special provi provision contained in the Code, appears to me to sion has been made the Ordinance which strengthen this view; and I therefore hold that authorises them is declared to be in force, if not the expression' all suits' must be limited to nean inconsistent with the Code of Procedure. That all suits by bill or information.' 1 may add proviso then leads us to examine Sec. IX-that I have come to the abuve conclusion with which enacts that all suits shall be commenced considerable doubt. by a general writ of summons except certain classes of cases hereinafter contained,' Those mean doubtless chains against the Govern ment, proceedings by agreement of parties, &c Now, the first question to be answered is whether proceeding by summons in Chambers for administration is a suit within the meaning of that term in Sec. D Daniell's Chancery practice clearly enough relers to it as a suit. There is no definition of 'suit' in the Code. In the Judicature Act of 1873, suit is defined as embracing action, and 'action' is defined as a civil proceeding commenced by writ or in such other manner as may be prescribed by Rules of Court, and shall not include a criminal proceeding. Sec. 100. Order 1. There exists at present among the Chinese WAN coolies in Singapore a widespread belief that in the outskirts of the town there prevails a system of cutting off the heads of unwary wayfarers, The purpose for which such atrocities are believed to be committed is unknown, nor is it known bow the bodies are disposed of, but on one point there is a fixed opinion--that the price given by some authority is $50 per bead. The district about Serangoon Road is specially obnoxious to finricksba coolies, who are firm believers in the tales which have been freely circulated. Indeed one of our staff, in order to test the accuracy of the above statements, asked six coolies in succession to carry him to that district, and in each case the men refuse, one remarking, when offered more than three times the fare," "I would not go there for $10. That the rumour is not confined to one class is certain, and that it should meet with such ready acceptance not only by coolies but by the many who have received a European eduastion, and who have a close intercourse with English- men, and who prove themselves as cute men of business, as can be found anywhere, offers a smewhat striking comment on our boastful presentations of the results of our govern
ment.
WHAT THE HEADS ARE WANTED FOR -From another source we learn that the Chinese coolles believe that their heads are wanted by the department of public works for the purpose of making sure the success of bridges now under construction,
The present rumour is on the same lines as one which circulated in India a few months ago when all over a wide district mothers lived in perpetual fear that their children would be stolen by the Government to be walled up alive in the fundations of a great bridge being built. The same" superstition indeed was current in Europe in older times.
and Vice-Chancellors. These proceedings have always been entitled In the matter of the Estate" of A.B., deceased-C. D. plaintiff and E. F. defendant; and in all decrees and orders made therein the proceedings were referred to at a master and cause as distinguished from a 'cause' alone. 'Cause 'and 'suit' seem to have been synonymous terms, see Seton on Decrees, 3rd Edition, p. 91 notes, p. 115 form 1 p. 116 notes. By Ord, No. 7 of 1856 Section 45 of the Act of 15 and 16 Vic c. 86 is with other sections extended to the Colony, and although repeated in England by the Statute Law Revision Act 1883, it has not hitherto been expressly repealed Hongkong. For the Respondent it was argued that the Hongkong Code of Civil Procedure has the effect of repealing it by implication, Sect. 4 of the Code enacts amongst other things that except so far as may be therein special'y provided, Acts or parts of acts of the Imperial Parliament relating to procedure are to bethence forth suspended, but it goes on to except matters
