Mr. C. Russell, QC, and Mr. Gwinne James to show cause against it..
Mr. Russell said the rule was obtained by the Attorney General on the tat of February, the, motion having been made before Mr. Baron 'Pollock and Mr. Justice Manisty. There was no esire on the part of Mr. Yates to escape from any onsibility or blame that might attach to him in fespect of the publication of the libel. He only wished that the true mensure of that responsibi lity or blame should be clearly understood. The libel was in these terms
A strange story is in circulation in certain sporting circles concerning the clopement of a young lady of very high rank and noble birth with a young peer whose marriage was one of affection, but whose wife has unfortunately fallen into a delicate state of health. The clopement is said to have taken place from the Bunting" field. The young lady, who is only one or two and twenty, is a very fair rider, and the gentle man a master of the hounds."
Mr. Russell proceeded to say that the Attorney General, in making his motion, referred to a num- ber of affillavits to show that by what seemed to be regarded as an exhaustive process those by whom he was instructed had arrived at the con- clusion that the Earl of Lonsdale was the only person who could be said to answer the description in the paragraph. As to that, it was only necessary to say now that the paragraph was read and taken as applying to Lond Lonsdale. Mr. Yates stated on affidavit that he was not the author of the paragraph, and did not in any way instigate the writing of it; that it was forwarded to the office of the World by a person of title, who for several years had been a paid contributor to the paper, and who moved in the same social circle, as the Earl of Lonsdale and the other deponents in these proceedings; and that he had given the name and address of that person to those who were instructed on behalf of his lordship. Not only had the name and address been given to the applicant, but the author of the paragraph, a lady, had written to these concerned, and who rightly and justly complained of that paragraph, expressing her deep regret at having been a party to its publica- tion. The learned counsel said he took it for
granted that those who had felt aggrieved at the publication accepted that apology.

opinion in any way to alter the case substantially in favour of the défendant which was not before the judges by whom the rule was granted. He was of opinion that there was no sufficient answer. The paragraph in question was one that was calculated Seriously to affect any one to whom it might be supposed to apply, and it had not been denied that it was a proper subject. for a criminal information.
Mr. Justice Lopes remarked on the scandal of persons of high rank contributing for pay such paragraphs to newspapers, and the editors of newspapers publishing them. His lordship also commented strongly on the serious responsibility |attaching to the publication of such libels, as calculated to give pain and cause distress in domestic circles. He agreed that the rule must be made alisolute.
Mr. Justice Mathew concurred.

The Attorney-General signified some dissent, Mr. Russell said that at any rate such a letter of apology had been written. Mr. Yates went on to state in his affidavit that he had no know telge or idea, nor any reason to think that the paragraph in question referred to or could refer to Lord Lonsdale, whom he had met in society some months since, and with whom he then con- versed on friendly terms; that subsequently, in January, he was told that some friend of Lord Lonsdale had said that the paragraph referred to his lordship, which he (Mr. Yates) did not and could not believe but that with the view of correcting any such impression, he directed that a paragraph on the subject should be published in the World, this para.but should any of them presume to posses Casks of PORK, 13 Casks of BEEF, and 7. It being admitted that the paragraph was without foundation, it was to be hoped that the name of no lady was connected with it; but it must be obvious that to keep up this matter as a subject of public comment could not fail to have a tendency injurious to some ex- tent to whomsoever the tongue of scandal chose to fix upon. If the Attorney General asked the court to make this rule absolute, their lordships would have no alternative, and he (Mr. Russell) and underbred people is dollars. Unable them
