I endeavoured to obtain passage in the P&O steam Vessel which will leave Marseilles on the 10th instant. The vessel was full but I have secured a berth to Bombay by the vessel leaving Marseilles on the 14th inst. The Railway through the northern provinces of India is open to Calcutta Except for a connexion of about 100 carriage miles and if all things go right I should be in Hong Kong sooner than by going round via Galle. I am however afraid of missing the steamer at Calcutta.

I would if possible take this route because the utmost change and variety of scene has been strongly recommended for me.

I therefore respectfully request leave to go if I find it convenient from Bombay by Railway to Calcutta and thence to Hong Kong.

I request Extended leave of absence from the 22nd of December when my present leave of absence will expire, with or without salary as may be right in case I miss the steamer at Calcutta due to any accident.

I have no present expectation that I shall require the Extended conditional leave, but I am most desirous to avoid any question which without such leave might possibly arise in Hong Kong from any irregularity.

I have the honor to be, My Lord, Your Lordship's most obedient Servant,

John Smale, Chief Justice of Hong Kong
