State to your Excellency that my reply above referred was founded, Excellent As upon to which I stated to your report from the Law Offices, Who based upon the assumption that your Excellency's letter of the 2nd December last intended to convey the fact that the "Tigre" was not engaged in conveyance of correspondence, but in the carriage of baggage only;
It was upon that assumption it was not considered by St. In. Government that the "Tigre" was in execution of Articles II and IV of the Postal Convention, 20 as to be within the scope of list: I of that Convention.
Her Majesty's Government did not however intend it to be understood that they considered the Postal Convention of 1856 to apply only to vessels engaged exclusively in carrying correspondence. They hold that vessels chartered and subsidized by either the English or French Governments as Packets, will be within the scope of Art: X of the Convention, provided they are actually conveying correspondence, notwithstanding that they may also be conveying Passengers and Merchandise, and as the "Tigre" was such a vessel and was engaged, St. I.
