I have been requested by the Acting Attorney General - whom I have ordered to enter a "Nolle prosequi" on the first day of next term - to allow him to prepare a report on the proceedings in the case, when he returns from vacation leave. I therefore reserve till then two observations which I might otherwise have thought it right to make on some Constitutional points affecting the Executive here in connection with the judgment of the Chief Justice, as it may be desirable that I should receive further instructions thereon.
