Having consulted with the Attorney General, Mr Panncifote, he advises that the Documents in Your Lordship's office in relation to this matter with the opinions of Mr Ball, late acting Attorney General, as well as his (Mr Panncifote's) observations thereon be put into the hands of Solicitor with instructions to prepare a case for the opinion of some eminent equity Counsel.
7. If on a full review of all the circumstances, the opinion of Counsel

is adverse to this Government or doubtful the Solicitor will no doubt take such measures as he may consider expedient, with a view to an arbitration or a compromise. If the opinion of Counsel be favorable to this Government, the claim of Mr. Duddell should be resisted.
8. The matter is of considerable moment to this Government not merely on account of the sum involved, but also because on the eve of framing the Supplemental and Annual Estimates, it is extremely embarrassing not to foresee what the Colony's liability may be in the matter.
