A Magistrate of Summary Jurisdiction is liable to be called upon from time to time to hear any case in the Supreme Court which the Chief Justice may specify, I am sure the Chief Justice will avoid selecting a case in which I may have been engaged as Counsel, as
Any difficulty of that nature, however, is not only very unlikely to arise but would equally be felt if the acting appointment were conferred upon any other practising Barrister.
With respect to criminal cases, thanks to modern Legislation, the Monthly Calendar is now so light that I scarcely anticipate the Chief Justice resorting to such assistance, but were it otherwise the Informations could be signed by any person nominated by His Excellency for that purpose under Ordinance 3 of 1865. Dev. 41.
I can only say, that should any real difficulty arise, I shall not lose a moment in placing my resignation of this acting appointment in the hands of His Excellency.
