I have no doubt that under the circumstances, Sir R. Macdonnell had little choice but to appoint Mr. Pauncefote as acting Judge provisionally.

The contraction is unusual, but I suppose that Lord Granville's despatch may be understood under the circumstances, but it is a matter of opinion whether it would not have been better to appoint a person other than Mr. Pauncefote, rather than risking the incapacity of Mr. Pauncefote, or causing trouble to an officer of Her Majesty's Government.
