My Lord,

I have the honour to affrize your Lordship that, having taken the opinion of my Executive Council on the subject, I have appointed the Attorney General, Mr Panncefoli, Acting Judge of the Summary Court—subject to your Lordship's approval.

It would be better, if other circumstances suiled, that the gentleman acting as Judge of the Summary Court, should hold no other office. Practically, however, no special inconvenience was found to result from Mr Ball's recently holding both offices. Moreover, as appears from Mr. Panncefoli's letter accepting the appointment, that gentleman only takes it conditionally that he be permitted to resign if any Public inconvenience ensues. He evidently does not anticipate any difficulty being thrown in his way by the Chief Justice, who has, I believe, personally given a promise to that effect.
