as it would be the Colonial Officers who would be the sole judges in such a matter, of what the case and common sense might require, I must decline to be responsible for the action which might be taken under such circumstances; and it seems the less necessary as you are plainly informed there would be no hesitation in acting in emergency as the Colonial authorities might themselves see fit, whatever might be the regulations in force!

"As to the reality of any amount of inconvenience actually experienced in the arrest of Criminals by the Hong Kong Police in Chinese territory, I do not think any case is very clearly made out. If the Criminals in question are British, a British Authority may follow and arrest them in Chinese territory, for by Treaty, the Crown has jurisdiction over them. I am not aware that this right has ever been contested by the Chinese. If, on the contrary, the arrest of Chinese subjects be contemplated, I know of no right, by Treaty or International Law, which would justify the Colonial authorities pursuing them into Chinese territory and
