Articles of the existing treaty between Great Britain and the Sandwich Islands, it appears not improbable that "The Hawaiian Government may dispute the claim of Her Majesty's Government to share unconditionally Commercial Advantages which The United States have purchased from the Sandwich Islands by important reciprocal concessions involving considerable pecuniary sacrifice And that His Lordship proposes before sending further instructions to Consul Wodehouse, to consult the Law Officers of the Crown upon the construction of the articles in question

In reply, I am to request that you will submit to Lord Stanley the following observations

"The two Articles in the Treaty with the Sandwich Islands to which (you refer to the same) refer substantially are as the corresponding Articles in several Treaties still in force with States in South & Central America

The 1st Article is what is technically termed the "Conditional most favored nation Clause" and stipulates reciprocal Equivalent Concessions as a condition of such treatment in respect of all "favors, privileges & immunities in matters of Commerce
