Nerval Officer for the time being to fill his seat in the court not he may feel inclined, whilst the Governor when necessary can always with the sanction of the Senior Naval Officer secure the services of some other Naval Officer unofficial member of the court. Otherwise it would seem expedient that the same Ordinance which amending has not yet been confirmed should be repeated this year, and reenacted with provisions remodelling the constitution of the court as Your Grace on further consideration might think expedient.

I would however propose if the latter course be adopted that an attempt be made to define the personnel of the court beyond including the Chief Justice and Judge of the Summary Court as members. The Chief Justice as already enacted should preside generally and Judge. It might be further enacted that the Governor should from time to time appoint three other Members, thus making the court to consist of five, whereof three to be a Quorum; precedence of Members to be regulated by existing usage in the colony.

In this way the Secretary of State could by instructions to the Governor cause the court to be constituted in such manner as might be proved by experience to be most expedient, and it is very possible that the Senior Naval...
