"His Excellency then invites the Council to a consideration of the correspondence between the Colonial Secretary and Mr. Hazeland, the Crown Solicitor, arising from Mr. Hazeland having retained in his hands £1000, a large sum of money received by him on account of this Government in September 1866.
"His Excellency reads the correspondence and points out that, not merely did Mr. Hazeland retain that large sum of money for a considerable period, but that when the Treasurer, being desired by the Governor to make inquiry on the subject, had applied to him, he sent a cheque for $1,000 instead of £1,000, apparently taking his chance of its being discovered; it being subsequently discovered that he had received the larger amount, whilst he described the sum in his reply to the Treasurer of the 20th October 1866 as 'the amount forfeited by "Messrs" Augustine Heard & Co through breach of the Emigration Agent's conditions.'
"Mr. Hazeland's defence amounted to nothing, because the forfeiture of a Bond for £1000 was subject to very unusual conditions.
