Section 5 provides whereby a proportionate sum
shall be refunded from
amount of duties paid
in
the
advance, which mode seems unexceptionable, and Section 8 provides that if the Judge of the Court
of summary jurisdiction should feel "himself bound by law to dismiss the Petition, the Governor
may nevertheless
in his discretion remit the
rate. The other Sections of this Ordinance are
auxiliary
Lustly I am of opinion that
the Governor
may, consistently with Her Majesty's
Instructions allow this Ordinance to take effect in this Colony
