37 I am not however positively that Mr Pollard has

ever

endeavoured to brow beat the Bench, but it is difficult to account

for

Mr. Smale's

Sudden irritation unless there had been previous occasion for it.

It

is however not the less to be

regretted that, so far as I can judge from

the enclosed evidence, he should have first

an

expression

like an action in reference to perfectly harmless and not addressed to the Bench and have so treated it afterwards

by rejection of all apology and explanation,

as to create finally

an amount of Public

excitement which cannot but tend to

lower the Bench far

more than ten

times the number of "Contempts" such as

those for which he has condemned Mr Pollard.

I have only to add that I have apprised Mr Smale of my receipt of the

enclosed declarations, and that he has

also been furnished with copies of all

the

correspondence with Mr Pollard.

40 Your Grace

will further observe that I have not thought it necessary to offer

any

observations

on

that part of the

petition

which

is a repetition of Mr Pollard's

request that the fitness for Office of

the Chief Justice shall be inquired into. I think it

may fitly

be left

to Your

Grace with such information as is

afforded by

the enclosed documents.
