and the Convicts, and as he did
not report Alves for negligence
I am
of opinion he did not
give such order for the Convict
to work to the west of the place
considered
dangerous
that either from a want of knowledge or by mistake on the
part of the Overseer of Convicts
the prisoners were placed much
too near (12 or 15
feet) the face
of the embankment, considering that a large quantity of rain had recently fallen.
That the Guard Alves has not told the truth when he
states, that the prisoners did not go nearer the dangerous spot,
than pointed out to
him by Mr.
Smith and myself yesterday - as
the earth now bears the marks
of picks which the prisoners said were used by
them on Monday.
Sergeant Gant positively
denies that he would have struck the Convict Chowreek if the
men did not work, but admits as a rule
that he does quish the Convicts on
the head with his stick when they
are
idle or
walking slow.
