the apprehension of immediate flogging is the direct consequence of identification and can deter the class of offenders alluded to.

13. I therefore justify the proposed enactment on the ground of its necessity as a measure of self-preservation and defence, and I know of no reason why Her Majesty's Government cannot also justify it as such to all the world in the peculiar circumstances of this colony.

14. I am now much embarrassed as to how I shall deal with the returned convict, as if it becomes apparent that he runs no risk of being flogged, his comrades will do so again. I therefore trust that Your Lordship, with the additional information supplied by my despatch No..., and by this, may see your way to allowing the provision for branding/flogging on the island, or at least that if modified, it may be applied to all cases where parties voluntarily petition for release on condition of branding, and of being flogged if they relapse.
