The Establishment of a new Court for the trial of Piracy cases which is proposed by this Ordinance gives rise to very important and difficult questions.
By the Imperial Act 12 & 13 Vic: c. 96 s. 1 Piracies Felonies &c committed on the seas within the Admiralty Jurisdiction are triable by the Courts of Criminal Justice in British Colonies in the same manner as if Committed within the limits of the Jurisdiction of Such Colonies and Section 2 contains a Provision that the Punishment for such Offences shall be the same as would be adjudged in England if the trial had taken place there.
