As a result, The Duke of Newcastle has confirmed Mr. Caldwell's dismissal. 10 July 1862.

It is possible - if he would consent thereto - that I might use Mr. Caldwell's services in getting up Secret Police - but a reinstatement of him in his former Office would be a public act - requiring special permission. I add that his former Office of Registrar General is at present filled and as it is in that department he would be most useful now in working the new Registration Ordinance. I would propose making him Assistant Registrar under the new system with £500, and also giving him £300 per annum as head and manager of the Secret Police.
