The 3rd Section of my Instructions limits the Legislative
Council to five Office
holders
therein specified, and frum- unofficial Members, the names
whom
of each of W. Whyte holds

five offices specified, and is not amongst the individuals named I therefore held and the
beneral agreed with me that the new destructions superseded all former arrangements

and excluded all whom they did not include. W. Whyte having however since resigned_ the
Council now stands as in the distruction - except that Mr Ball
as
Acting Chief Justice takes his cent in the latter capacity.
Mr. Sutherland is absent on leave
as
reported in
my despatch of the 28th Ultimus, and M. Chorley has resigned..
